Illinois is not one of the states which recognizes common law marriage. Thus, to become married in the state of Illinois, one has to obtain a marriage license, etc.
In some cases, an illinois court *might* recognize a common law marriage which had been formed in a state which does recognize them.
This is one of the problems with living together without the benefit of marriage. The rights of the partners to the equity in the house, for instance, will not be the same as if there was a valid marriage.
Without knowing more about the situtation, I can't answer your question. I strongly suggest that you (or the person who contributed to mortgage, etc) consult with an attorney licensed in Illinois. For a referral, contact your local or state bar association.
