My fiance is a resident of Oklahoma USA and i am a British National. I want to marry him while on the visa waiver program which expires 24th Nov 2007. I must return to England before that date. Can i marry him while on the visa waiver program and apply for adjustment of status? What documents will i need in order to obtain our marriage license?Marriage to a foreign national in the state of oklahoma?

If you get married before the 24th of November you will not have to leave. Your British passport should be all you need as ID in order to get a marriage license.





After you get married in the US it's very simple to get your status changed to immigrant and get your green card. After you get the official certificate of marriage your American husband should file the following forms with the Citizenship and Immigration Service....





I-130 (petition for alien family member)


I-134 (affidavit of support)


I-485 (application to adjust status)


I-765 (application for work permit)


G-325 (bio data)

Marriage license is easy part, and yes you can adjust. It will take time and some money but it is worth it.





as soon as you get married you can get the ball rolling on permanent residence, this may be difficult because you are Visa Waiver and they generally require you to return to you country before the I-94 expires. Also as a side note you probably can't adjust to another non-immigrant status or extend your current status for the same reason.





If you get married and get a imm lawyer to get a case pending for you you will be able to stay within the United States* until your case is resolved with an immigration judge. You may also be able to get work authorization, but as i mentioned before this is not easy stuff. the cheaper/easier way to go about it would probably be for you to return to native country (unmarried)and start the K-1 visa process.

To the best of my knowledge it's a simple process.


Obtain your marriage license from your local county clerk. Locate and pay a Justice of the piece to conduct the service, file the marriage license with the county clerks office. Get 10 or so certified copies of the license and your off and running. good luck
