How long before gay marriage is taken to the federal supreme court?

Probably not until a couple more justices have retired.





Proponents of gay marriage do not want to put the question before the Court with its current make-up, since most legal analysts believe it would currently be a toss-up, and once the Court has ruled on a subject, it is rare for them to reverse themselves in the future.





Obama is likely to have to appoint at least two, and probably three, Justices during his first term. With an even more strongly Democrat controlled Senate now to confirm his appointees, he will be able to appoint very liberal justices, making the courts decision much surer for his position.

It will only get taken to any court when someones rights are affected by the right to engage in or not engage in a gay marriage.





Usually the Supreme Court of the US only addressees questions of constitutional dimension.





So, probably when there is a case involving inheritance rights, or custody of children.
