Thanks I hope you can help us!Can an American Lawyer Marry us in the States and the Marriage be Legal in Canada as well?
Lawyers are not authorized to perform marriage ceremonies. Legally registered marriages in one country are recognized by other countries, and that includes Canada recognizing marriages legally performed in the US and vice versa.
You are going to have to go through immigrations procedures whether you decide to live together in Canada or Costa Rica. If you marry in the US, however, you two have a lot of explaining to do, such as what you are doing in the US, what is your status here, and why did you choose to have the wedding in the US?
Then before you go to Canada, he has to apply for your immigration visa, etc., and if he applies for you while you are in the US, you have to document your status here. If you are here illegally, or ever violated any immigration laws, you will be refused admission to Canada. Most countries refuse to admit anyone who has violated the immigration laws of any other country.
You are better off either applying for him to come to Costa Rica and marry you at home with your parents, etc. in attendance (marriages are traditionally performed at the bride's country and hometown!). Or else he needs to apply for you to enter Canada and perform the wedding ceremony there. Trying to marry in the US without a REALLY good reason will have investigators sniffing out marriage fraud. Can an American Lawyer Marry us in the States and the Marriage be Legal in Canada as well?
If your marriage is LEGAL it will be recognized in Canada. However, this does not mean that you will be able to enter Canada and live happily ever after. You must still apply for permanent residence. You could apply under the family class since you will be married to a Canadian. You can apply from inside or outside of Canada but if you apply from the States then you need to be there legally and you will have to stay there until the application is processed and it could take a few years.
Check out the website for Immigrations Canada. www.cic.gc.ca
It'll be recognised. But I don't know if it will make you eligible to live in Canada.
I'd suggest having your sig other contact his or her MP about immigration laws concerning marriage. You might get a free pass, you might get bumped to the top of the immigration line. I'm not sure how that works. And Canada.gc.ca has little information on the subject.
Lawyers don't marry. You will need a justice of the peace. A legal marriage certificate will be recognized.
No. Lawyers do not perform marriages.
