California is a community property state. All martial assets belong to each partner equally. There are some special circumstance where that isn't true, like an inheritance, but generally, everything used during the marriage is owned equally.
Often Courts decide who gets what unless the Petitioner and Respondent can agree before the Divorce Decree.
Any gift that was given to YOU only are yours. Any gift that was given to BOTH of you are to be split.
