The question before the court isn't actually about gay marriage. It's whether the voters are able to change a low. Can the court overturn a vote that indicates the ';will of the people.'; I think this is an important issue.

They will uphold prop 8, because all it really does is define the word marriage.
I hate to say every word has a meaning and we have legal definitions of words, but we do prop 8 was just the voters defining what the word marriage means, nothing more nothing less.
I remember a president not so long ago who said “That depends on what your definition of ';is'; is” so prop 8 defined marriage.
I find it funny that if prop 8 would have went down we would have heard the voter have spoken, but it didn't and we are hearing how unfair it was.
I find it interesting that the court's are asking tough questions that leaves one with an impression that they will not overturn Prop 8. My feeling is that it means they're leaving ';no stone unturned';. My feeling is that they will find Prop 8 unlawful because it's an attempt by voters to revise a law which the courts had already established. It's going to be a long nail-biting battle, but I am optomistic marriage equality will prevail.
At least with the court hearing the oral arguments today, there's hope that :
1. Prop 8 will be overturned
2. They won't nullify those 18,000 SSM that were performed legally before Prop 8 passed
But no one really knows, except for the CSSC. That's why so many people, legal experts, etc., are putting their 2 cents in to say how they THINK the court will rule.
Personally, I'd love it if they'd overturn Prop 8. If that doesn't happen, at least don't nullify those 18,000 SSMs that were performed pre Prop 8. The LGBT community can always re try with another gay marriage ballot in the future. If the court lets Prop 8 stand AND nullifies those marriages, I will be devastated, to say the least.
But, I see the historical significance %26amp; will keep our wedding pics, our marriage license, the broom we jumped right after the ceremony into the land of the married %26amp; show them to the future generations. I still have 4 nieces %26amp; nephews, %26amp; my wife %26amp; I will still adopt kids. I know by the time these kids are teens/our age, they won't believe that their Aunts %26amp; Moms had to go through all this rigamarole to get our marriage recognized by the State %26amp; the US Government.
The court will uphold the decision made by the voters - (it can come back on a next ballot) but the court won't overturn the vote. The 18K that have a license will keep them and they will remain valid. Get back to work CA - Put it back on the ballot - just say no to mormons (morons). I can't even give that religion a capitol letter.
The CA Supreme Court has already ruled once in favor of gay marriage. I have hope that they will overturn Prop 8 which is a majority vote to rescind rights the court granted to a minority. If they don't then any rights held by minorities are up for a popular vote and could be rescinded.
I really, really hope they overturn Prop 8.
That was a rotten, terrible thing that people did by voting to pass that. Absolutely heartless and ignorant. There's no excuse in the world good enough to keep toying with people's love lives like that, giving something to them and then taking it away over and over.
We're people. Living, breathing, thinking and feeling people. We're in America. These are rights that we should have just because we're living in a country where you're supposed to be able to build your dreams and live them. But no, America sends a very clear message: you can only be free and have your dreams so long as the rest of us approve of them. What kind of crap is that?
Let people marry, for crying out loud. It doesn't hurt a damn soul to let gays marry... but it hurts millions to not. :/
And to Republic... Yes, this is a democracy. So how is it democratic to strip people of their rights AS PEOPLE? How is refusing someone the right to marry just because they are the same sex keeping with the Liberal platform? Sorry, but you're completely and utterly wrong-- it's the Republican mindset that got Prop 8 passed to begin with. It's the Liberal mindset that's going to restore things to how they SHOULD be: with people having rights they were already granted and should have had from the start.

I hope the courts will throw out Prop 8. It is clearly unconstitutional to remove rights, which have already been granted, from a minority group, particularly with such a narrow majority.
I think prop8 is unconstitutional. We are still people and we deserve to be treated the same as straight couples.

Start begging for individual rights...and for Republic principles.
If we live in a democracy...the people have spoken.
Unless California...changes to a Republican state overnight...Prop 8...wont be overturned.
